Vancouver Developer Faces Jail Over Financial Disclosure

A Vancouver real estate developer, Helen Chan Sun, potentially faces imprisonment before the end of the month unless she reveals her financial status to the B.C. Supreme Court. Sun, with a net worth estimated at a minimum of $20 million, was previously given a 40-day jail term for contempt of court after failing to comply with a payment order. However, Justice Richard Fowler suspended the sentence until February 20 to allow Sun time to provide a full account of her income and expenses.

Simultaneously, a separate group of creditors is seeking a bankruptcy order against the 49-year-old CEO of a development company involved in various residential projects across Greater Vancouver. Sun, who is also dealing with a substantial tax bill from the Canada Revenue Agency amounting to nearly $6 million, has been criticized for not fully disclosing her financial situation.

Despite attributing her financial struggles to Vancouver’s declining real estate market, Sun has been accused of living a lavish lifestyle inconsistent with her claimed income. Court documents reveal discrepancies in her financial disclosures, raising concerns about her spending habits, including luxury purchases and extravagant vacations.

Sun’s financial woes stem from a $4.5 million mortgage issued by GC Capital Inc. for a failed real estate project, for which she and another individual guaranteed repayment. While Sun made partial payments towards the debt, she ceased payments in 2022, leading to legal actions against her.

Furthermore, Sun’s investments in properties in the Cambie Corridor, once a thriving real estate hub, have been affected by the market downturn. Her company, Landmark Premiere Properties Ltd., is facing financial challenges, with several properties in receivership and unsold residential units.

As creditors seek remedies for the outstanding debts, Sun’s compliance with court orders for financial disclosure is crucial to avoid potential imprisonment. The court has emphasized the need for transparency in her financial dealings, including detailed income sources and expenses, to address the mounting legal issues.
