Woman Testifies on Mother’s End-of-Life Suffering in MAID Dispute

The B.C. Supreme Court accepted testimony on Tuesday from a woman who claimed her mother endured unnecessary suffering during her final moments after being moved from St. Paul’s Hospital to a neighboring facility for medical assistance in dying. The incident took place just before a trial challenging the right of faith-based institutions to prohibit MAID was set to begin. The affidavit provided by Alexi Rivera detailed the delays and challenges her mother, Anna Chamberlain, faced in being transferred to the Shoreline Space, an adjacent area managed by Vancouver Coastal Health for MAID services. The defense argues that these adjacent spaces streamline the transfer process, eliminating the need for ambulance transport to another facility.

The case involves three defendants – the B.C. government, Providence Health Care, and the Vancouver Coastal Health Authority – and is being presided over by B.C. Supreme Court Chief Justice Ronald Skolrood. Witnesses, including current and former Ministry of Health officials, have testified about the province’s MAID policy and the complexities of ensuring care provision in faith-based facilities. The policy allows such providers to opt out of offering MAID but mandates cooperation for efficient care transfers and information sharing.

Providence Health Care, a non-profit organization affiliated with the Catholic Church, plays a crucial role in delivering health services in the community, including operating St. Paul’s Hospital. Government witnesses highlighted the significance of Providence in the healthcare system, citing its role in heart transplants, specialized care services, and contributions to infrastructure development. The trial is ongoing as further testimony is being presented.
